| (MentionedIn) Will | 26 August 1812 | She was mentioned in the will of George Ludwig (Lewis) Coffinberry (Immigrant 1752) on 26 August 1812 at will bk 5 pg 59, Berkeley Co., West Virginia; I George Lewis Coffinberger of the County of Berkley & State of Virginia, being of sound & perfect mind & memory do on this 26th day of Augt 1812 make and ordain this my last will & testament in the manner & form & allowing making void all other former wills heretofore made by me to viz 1st I give and bequeath to my wife Fanny Coffenbarger the sole use and profits of my whole estate both real and personal of whatsoever kind I may own at the time of my death during her natural life. 2nd It is my will & desire that the proceeds of my estate real & personal after the payment of my just debts & all necessary expenses & charges shall be equally divided between my eight daughters and sons herein after named to vis. Mary Newman, Elizabeth Curtus, Nancy Seybert, Fanny Sipp, Sarah McCasland, Catherine Young, Jacob Coffenberger, & George Cofffenberger or their living children to be equally divided between them share & share alike except the part bequeathed Sarah McCaslin her equal part is to be put to interest by my executors and she is only to receive the legal interest thereof during her life & at her death it is to be equally divided between all her living children. 3rd I hereby consititue & appoint my friends Thomas C Smith & Obed Wait the sole executors of this my last will & testament it will be understood that my executors are fully authorized to sell real estae as well as personal & convey in full authority in witness whereof I have herunto set my hand & seal the date and year above written my executor are not to give any security for the performence as executors. (tax records started 1811, with 1812-1813 missing). There is also a George Young. (SLC 1870186). In 1818 two horses but no males over 16. George still there but no other Youngs, so what happened to the male from 1817? No Youngs in 1818, and in 1819 there is only a John Young. George Young is back in 1820 (the only Young). No Youngs in 1821. Catherine back in 1822 with 1 horse etc and 1 male over 16, there is also a John Young (no horses). 1823 1 horse, no males, plus George and Joseph one male each and no horses. 1824 no Catherine but William 1 male 2 horses, 4 slaves, another William 1 male no horses, George 1 male no horses, and Hiram 1 male no horses. 1824 Benjamin Harvey Jr and Sr each have 2 horses, Jacob and John Young each have 1 horse and Newton and George Young have none. Witnesseth that the said William Wilson executor sold by public vendue for the sum of three hundred dollars to him in hand paid by the said Catherine Young the receipt thereof is hereby acknowledged hath given granted sold and conveyed and by these presants doth give grant sell and convey to the said Catherine Young widow, a certain tract or parcel of land lying and being situated in Ohio county and State of Virginia on the waters of Buffaloe Creek and bounded as followeth towit; beginning at a sugar tree corner to Nicholas R[oger__?] and with his line south 20 degrees east 60 poles and three quarters to a white oak corner of Henry Young decd, and with his line north 83 1/2 west 89 poles to a post on [Rodyers?] line and with the same south 67 1/2 east 70 poles to the beginning containing 30 acres being part of a tract containing 400 acres granted by Beverly Randolph Esqr Governor of Virginia to Benjamin Ogle heir at law of Jacob Ogle decsd, by patent bearing date of 23 December in the year of our Lord 1785 & of the Commonwealth, the 11th part conveyed to Mary Ogle and part claimed by James Ogle by heirship conveyed bearing data of 29th Janry 1795 by them conveyed to Solomon Porter by him conveyed to Hugh P[iani?] by a conveyance bearing date of 7th August 1797 and by him to Robert Cochran and by him to Lydia Donavan widow to have and to hold the said tract of land with its appurtenances to the said Catherine Young widow, her heirs and assigns forever. Witnesseth that a marriage is shortly to be had and solomnized between the said Benjamin & Catherine, and whereas the said Catherine is seized and possessed of the following described real estate situated in the county of Ohio and state of Virginia on the waters of Buffaloe and bounded as follows towit: beginning at a sugar tree corner to Nicholas Rogers and with his line south 20 degrees east 60 3/4 poles to a white oak corner of Henry Young decd, and with his line north 83 1/2 west 89 poles to a post on Rodgers line and with the same south 67 1/2 east 70 poles to the beginning containing by estimation 30 acres. It is the same tract of land that Catherine now lives and whereas the said Catherine is also possessed of the following articles of personal property towit one mare one cow three heifers 12 sheep, one bureau, one kitchen table, two bedsteads and bedding, six winsor chairs, one iron kettle and one Do. [ditto for iron] pots tea kettle; and whereas the said Benjamin and Catherine is desireous and willing that the said Catherine should ever retain the disposal and use of the said property both real and personal notwithstanding the said intended marriage, now therefore this indunture witnesseth that the said Catherine Young by and with the consent of the said Benjamin Harvey in consideration of the promises and in further consideration of the sum of one dollar to her in hand paid by the said William Wilson his heirs and assigns forever all the before described tract of land situated and bounded as aforesaid & supposed to contain thirty acres as [abound?] together with cash and every article of personal property mentioned or described as aforesaid to have and to hold to the said William Wilson his heirs and assigns forever all the aforesaid real and personal property in trust nonetheless for the use of the said Catherine until the said marriage can be had and solomnized and in further trust that from and after the solomnizing of the said marriage the said William shall truly suffer and permit the said Catherine to rent sell or barter all or any part of estate hereby conveyed and apply the profits of the same or the fund of the sale to her own separate use during the continuance of the said marriage and further to do every [art?] respecting the said estate which an unmarried woman could might lawfully do, and also in further trust that if the said Catherine should die previous to the said Benjamin [need to finish this]. |
